HaptoTerms of Service
These Terms are a binding agreement between you and Asif Iqbal ("Hapto", "we", "us"). By using any Hapto product, software, or service (the "Services"), you agree to them.
1. Who we are and what we offer
Asif Iqbal builds creative and AI-powered software products and services. Some products are offered on a pay-as-you-go basis using prepaid credits (digital goods); others may be free or offered separately. These Terms apply to all of them, alongside any product-specific terms we provide.
Hapto is an independent product and is not affiliated with, endorsed by, or sponsored by Canva. Canva is a trademark of Canva Pty Ltd. References to Canva describe interoperability only.
AI image generation is powered by leading third-party AI models. Hapto is an independent product and is not affiliated with, endorsed by, or sponsored by those model providers, and their names are not used in our product names.
2. Eligibility
You must be at least 18 years old (or the age of legal majority and consent in your jurisdiction, whichever is greater) and able to form a binding contract. You are responsible for activity under your account.
3. Your content and the licence you give us
You keep ownership of the content you provide ("your Content") and of any results you create with the Services. Where a product lets you upload images of people, you represent that you are that person or have their explicit consent, that no public figure or third party is included without consent, and that no minors are included. See our Acceptable Use Policy.
You grant us a limited licence to host and process your Content solely to provide the Services to you. We do not sell your Content, and we do not use content you upload to train AI models. We retain it only as needed to run and support the Services and then delete it as described in our Privacy Policy.
4. Acceptable use
Your use is governed by our Acceptable Use Policy. Violations may lead to suspension or termination and, where the law requires, reporting to the authorities.
In particular, you must not create or upload NSFW, pornographic, adult, or sexually explicit or suggestive content, and you must not attempt to bypass or obfuscate our content-safety controls. To enforce these rules we screen both your prompt and the photos you upload before generating — including automated detection of recognizable public figures, apparent minors, and explicit imagery — and block requests that violate them.
5. AI outputs
Where a product generates content using AI, that content is synthetic and AI-generated, may be inaccurate, is provided "as is", and must not be presented as an authentic record of real events or as an endorsement by any person. You may use AI outputs for personal, non-commercial purposes; commercial use requires our prior written consent.
6. Payments
Where the Services are paid, prices are shown before purchase. Payments are processed by our authorised Merchant(s) of Record (for example Creem internationally and Razorpay in India), who act as the seller of record, handle applicable taxes, and appear on your statement. Credits are added immediately on successful payment, are tied to your account, and are non-transferable. Refunds are governed by our Refund Policy.
7. Suspension and termination
We may suspend or terminate access for breach of these Terms or to comply with law. You may stop using the Services at any time.
8. Indemnity and liability
You agree to indemnify Hapto against claims arising from your Content or your use of the Services in breach of these Terms. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 3 months before the claim, and we are not liable for indirect or consequential damages.
9. Governing law
These Terms are governed by the laws of India, and disputes are subject to the courts of Bengaluru, Karnataka, India.
